Terms & Policies
These terms cover the purchase of original artworks by me, Marina Ogai. By placing an order, you agree to them. Last updated: August 2026.
Jurisdiction & Sales Territory I work as an artist. I do not conduct any commercial sales, marketing, or delivery of physical artworks within the territory of Indonesia. All transactions and shipments are strictly international.
Who you're buying from The sale is handled by my international representative, Flava app (registered in Georgia), who invoices you and receives payment. I remain the artist and creator behind the work — each piece is an original I built by hand.
Every piece is one of a kind. The conflict between control and improvisation in my process means no two works are alike; splatters, rough textures, or sharp strokes are evidence of the physical action, not flaws.
Prices & payment All prices are in US dollars (USD). The price of the artwork covers the work itself and a signed Certificate of Authenticity. You choose a shipping option at checkout, and its cost is added to your total. Any import duties and customs fees in your country are separate and are your responsibility. Payment is processed securely through PayPal to my representative. Physical ownership of the work transfers to you once full payment has cleared.
Shipping & delivery Works ship internationally, with the strict exception of Indonesia, exclusively to the following 19 destinations: United States, United Kingdom, France, Germany, Switzerland, Italy, Spain, Netherlands, Belgium, Austria, Japan, South Korea, Singapore, Hong Kong SAR, Australia, New Zealand, Canada, United Arab Emirates, and Saudi Arabia. Your work is exported and shipped by a licensed export company appointed by my representative. Works are heavily protected, professionally packed, and fully insured. Shipping is charged at flat rates based on the required physical packaging (flat pack, tube, or crate). Delivery times are estimates — borders, customs, and weather dictate the actual transit time.
Territorial Restrictions & Shipping Sales and shipping are international only. No physical artworks are sold or delivered within Indonesia. To ensure compliance, the checkout system on this site is configured to automatically block any domestic Indonesian transactions or shipping addresses.
Customs, duties & taxes You are the importer. Any import duties, VAT, or customs fees charged by your government are your responsibility and are not included in the price or shipping. Every shipment is declared honestly at its true sale value. We will not under-declare a work or mark it as a "gift" – doing so is illegal and voids the shipping insurance.
Damage in transit & claims Every work ships insured. Inspect the package the moment it arrives. If the artwork reaches you damaged, email us at the address on my Contact page within 5 days of delivery. Include clear photos of the damage and all layers of packaging. Keep the packaging until the claim is resolved; the carrier requires it. Based on the situation, we will arrange a repair, replacement (if applicable), or a refund.
Returns & refunds Each original is a unique physical object. Returns based on personal preference are not accommodated. This does not override your statutory consumer rights – if you are a private buyer in a jurisdiction such as the EU or UK that mandates a withdrawal period, those rights apply. Screen colors can differ slightly from physical oil or ink; these natural variations are inherent to the material.
Copyright & reproduction When you buy an original, you own the physical object. You do not acquire any copyright or reproduction rights. The copyright for every piece remains with me, Marina Ogai. You may keep the work, display it, lend it, or resell the physical piece. You may not reproduce it, make prints, use the image commercially, or mint it as an NFT without my written permission. I retain the right to reproduce my own works for my portfolio, exhibitions, press, and to produce limited-edition prints, unless agreed otherwise in writing. Any transfer of copyright requires a separate written contract.
Authenticity Every original ships with a Certificate of Authenticity detailing the title, year, medium, and exact dimensions. Keep it safe – it is the factual provenance of the work, and you'll need it if you ever resell.
Privacy Your personal details are used only to process your order, ship the work, and stay in touch with you about it. To do this, my representative shares what's necessary with the services that make the sale possible: PayPal handles your payment, and the courier (DHL, FedEx, or EMS) receives your name and address to deliver the work and clear customs. We don't sell your data or use it for marketing. We keep it only as long as needed to fulfill your order and meet accounting and tax obligations. You can write to us at the address on my Contact page at any time to ask what we hold about you, correct it, or have it deleted.
Governing law & disputes If something goes wrong, write to us first – most issues are resolved through direct, honest dialogue. These terms are governed by the laws of Georgia, where the business is registered. If you are a consumer, the mandatory consumer-protection laws of your country apply regardless.
Changes & contact We may update these terms. The version that applies to your order is the one live on the site when you place it. For any questions, write to the address on my Contact page.
