Terms & Policies
These terms cover the purchase of original artworks by me, Marina Ogai. By placing an order, you agree to them. Last updated: October 2026.
Jurisdiction & sales territory
I work as an artist. I do not conduct any commercial sales, marketing or delivery of physical artworks within the territory of Indonesia. All transactions and shipments are strictly international, and orders with a shipping address in Indonesia are not accepted.
Who you're buying from
The sale is handled by my international representative, Flava app (registered in Georgia), who receives payment for orders placed on this site. I remain the artist and creator behind the work – each piece is an original made by hand.
Prices & payment
All prices are in US dollars (USD). The price covers the artwork itself, a signed Certificate of Authenticity, and standard shipping. It does not include import duties or customs fees in your country, or the optional wooden crate, which you can add at checkout. Payment is processed securely through PayPal to my representative. Physical ownership of the work transfers to you once full payment has cleared.
Shipping & delivery
Standard shipping is included in the price. Every work is fully insured and sent with a tracked express courier. How the work travels depends on what it is. Canvases up to 150 cm on the longest side are shipped stretched on their stretcher bars, in a rigid box with protective padding, and arrive ready to hang. Larger canvases are shipped unstretched: the canvas is taken off its stretcher bars, rolled around a protective core and sent in a rigid tube. It then needs to be restretched on arrival – a local framer can do this. Works on paper are always rolled and sent in a rigid tube. A custom wooden crate is available at checkout as a paid option. It keeps a canvas stretched on its bars for the whole journey and is the safest way to move a large painting. Standard shipping covers 19 countries: United States, United Kingdom, France, Germany, Switzerland, Italy, Spain, Netherlands, Belgium, Austria, Japan, South Korea, Singapore, Hong Kong SAR, Australia, New Zealand, Canada, United Arab Emirates and Saudi Arabia. Checkout will not accept an address outside this list – if your country is not on it, write to me before ordering and I will see what can be arranged. Transit time is usually 7–21 days depending on the destination and customs.
Customs, duties & taxes
You are the importer. Any import duties, VAT or customs fees charged by your government are your responsibility and are not included in the price. Every shipment is declared honestly at its true sale value. I will not under-declare a work or mark it as a "gift" – doing so is illegal and voids the shipping insurance.
Damage in transit & claims
Every work ships insured. Inspect the package the moment it arrives. If the artwork reaches you damaged, email the sales team at the address on my Contact page within 5 days of delivery. Include clear photos of the damage and all layers of packaging. Keep the packaging until the claim is resolved; the carrier requires it. Depending on the situation, I will arrange a repair, a replacement (where possible) or a refund.
Returns & refunds
Each original is a unique physical object. Returns based on personal preference are not accommodated. This does not override your statutory consumer rights – if you are a private buyer in a jurisdiction such as the EU or UK that mandates a withdrawal period, those rights apply. Screen colours can differ slightly from the physical painting or drawing; these natural variations are inherent to the material.
Copyright & reproduction
When you buy an original, you own the physical object. You do not acquire any copyright or reproduction rights. The copyright for every piece remains with me, Marina Ogai. You may keep the work, display it, lend it, or resell the physical piece. You may not reproduce it, make prints, use the image commercially, or mint it as an NFT without my written permission. I retain the right to reproduce my own works for my portfolio, exhibitions, press, and to produce limited-edition prints, unless agreed otherwise in writing. Any transfer of copyright requires a separate written contract.
Authenticity
Every original ships with a Certificate of Authenticity detailing the title, year, medium, and exact dimensions. Keep it safe – it is the factual provenance of the work, and you'll need it if you ever resell. Every piece is one of a kind: the conflict between control and improvisation in my process means no two works are alike – splatters, rough textures or sharp strokes are evidence of the physical action, not flaws.
Privacy
Your personal details are used only to process your order, ship the work and stay in touch with you about it. To do this, my representative shares what's necessary with the services that make the sale possible: PayPal handles your payment, and the courier receives your name and address to deliver the work and clear customs. Your data is never sold or used for marketing. It is kept only as long as needed to fulfil your order and meet accounting and tax obligations. You can write to the sales team at the address on my Contact page at any time to ask what is held about you, correct it or have it deleted.
Governing law & disputes
If something goes wrong, write to me first – most issues are resolved through direct, honest dialogue. These terms are governed by the laws of Georgia, where the business is registered. If you are a consumer, the mandatory consumer-protection laws of your country apply regardless.
Use of images and video
All images, video and text on this site are my work and remain my copyright. None of it may be copied, reposted, reproduced or published anywhere without my prior written permission. This includes reposting on social media even with credit and a link; re-uploading my video or process footage; using my work in advertising, on products, in print, or in NFTs and digital editions; and using my work to train AI models or to generate derivative images. Removing, cropping out or obscuring my signature or watermark is not permitted in any case. This also covers my texts – artwork descriptions, concept texts and essays – and close copies or imitations of a specific work of mine.
